General Terms and Conditions (GTC) – LUMORNA

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders, purchases, and license agreements made through the online shop of LUMORNA – Stefan Rüegsegger, Dorfstrasse 19, 3127 Mühlethurnen, Switzerland (hereinafter referred to as “Provider”) and customers.

2. Conclusion of Contract

The presentation of products and licenses in the online shop does not constitute a legally binding offer, but an invitation to place an order. The contract is only concluded when the provider accepts the order by means of an order confirmation via email or delivers the goods/license.

3. Prices and Payment Methods

All prices are quoted in Swiss Francs (CHF). VAT will be shown if legally due. The prices and payment options specified in the checkout at the time of order placement apply.

4. Delivery and Provision

• Digital Products & Licenses: Will be provided electronically (via email or activation) after full payment has been received.
• Physical Products: Will be shipped to the delivery address provided by the customer. Delivery times are non-binding unless expressly agreed otherwise.

5. Returns and Refunds

In Switzerland, there is no legal right of withdrawal for online purchases. All sales are binding and final.

• Digital Content & Licenses: No right of return after provision.
• Physical Products: Returns are excluded, except in the case of proven manufacturing defects. In such a case, LUMORNA will take back the product and refund the purchase price or provide a replacement.
• Custom-made products: Excluded from the right of return.
• EU Customers: The legal provisions of the EU Consumer Rights Directive (14-day right of withdrawal) apply. For details, see the separate Returns & Refund Policy.

6. License Provisions for 3D Print Models

The following provisions apply to the acquisition of commercial licenses:

• Usage: The license exclusively entitles the licensee to sell physically printed end products within the agreed scope (standard: max. 500 copies per model/year).
• Prohibition of transfer: The transfer, resale, or distribution of the digital design and STL files to third parties is strictly prohibited.
• Labeling: For all sales and promotional activities, the note "Design by LUMORNA" must be clearly displayed.
• Contractual penalty: In the event of unauthorized disclosure of the digital files or use without a valid license, a contractual penalty of CHF 500.– per model and infringement will be due. Further claims for damages remain reserved.

7. Warranty and Liability

The provider warrants that the delivered products are free from manufacturing defects. The provider is not liable for damages caused by improper handling, faulty self-printing, or unsuitable material selection by the customer/licensee. Furthermore, liability – to the extent legally permissible – is limited to the direct value of the goods or license.

8. Data Protection

The processing of personal data is carried out strictly in accordance with the provisions of the Swiss Data Protection Act (DSG). Detailed information can be found in the separate data protection declaration.

9. Applicable Law and Place of Jurisdiction

Only Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is the domicile of the provider (3127 Mühlethurnen, Canton of Bern).
